By ordering from me you've agreed to and read the terms. Please read them carefully before placing an order.

General

All commissions must be ordered through my Discord server unless otherwise agreed upon. Discord is my primary method of communication and allows me to keep commission information organized.Payment is required before I begin working on a commission.I reserve the right to decline any commission for any reason.Commissions are completed on a first-come, first-served basis unless otherwise stated.Commission turnaround times are estimates and are not guaranteed unless a specific deadline has been agreed upon in writing.Any mistakes made on my behalf (e.g. misread description, missed a detail, etc) will be corrected for free. On the other hand, if the mistake happened because of insufficient information or you forgot to mention something when ordering I will not make any changes unless paid to do so.Expect orders to be something similar to the artworks I show in the examples or my social media. I will not copy others' exact style. I am fine trying new general styles but will not imitate others.I do not accept commissions involving harmful, hateful, discriminatory, or bigoted themes of any kind. If I later discover that a commission contains harmful, hateful, discriminatory, or bigoted themes, references, symbols, or messaging, I reserve the right to immediately and permanently revoke any permission granted to the client to use the artwork, in addition to cancelling the commission without a refund where applicable.I retain the right to display commissioned artwork, sketches, WIPs, and completed pieces on:
・My portfolio
・My website
・My social media
・My discord server, discord dms or in other servers
・During advertising
・Promotional materials
If you require a commission to remain private, this must be discussed and agreed upon before the commission begins.I reserve the right to update these Terms of Service. The version in effect when your order is placed will apply to that commission unless otherwise agreed upon in writing.

Copyright & Intellectual Property

I retain copyright and intellectual-property rights to all original artwork I create, including commissioned artwork.Purchasing a commission does not constitute a transfer of copyright ownership.Clients may not:
・Claim my artwork as their own
・Resell my artwork
・Trade my artwork
・Redistribute my artwork
・Reproduce my artwork
・Trace my artwork
・Substantially copy my artwork
・Remove required credit or identifying marks
・Use my artwork as a template for creating derivative artwork
・License or sublicense my artwork to another person
・Sell rights to my artwork to another personCommissioning artwork does not grant ownership of my original artistic work, techniques, templates, or creative process.This does not give me ownership of third-party intellectual property, such as characters, logos, trademarks, or other material belonging to someone else that may be referenced with permission from their creator in a commission.My artwork, sketches, WIPs, templates, and other creative materials may not be traced, directly reproduced, substantially copied, or used as the basis for creating another artwork.Any unauthorized reproduction or unauthorized use of my copyrighted work will result in appropriate copyright enforcement, including a DMCA takedown request where applicable.None of my artwork, including commissioned artwork, may be uploaded to, submitted to, processed by, used as training data for, or otherwise used with generative AI or machine-learning systems.This includes, but is not limited to:
・AI image generators
・AI training datasets
・Image-to-image generation
・AI editing or modification systems
・AI art generators
・Future technologies that perform substantially similar functionsClients may not use my artwork to generate, train, modify, or create AI-generated content.
If a client is knowingly involved in the unauthorized creation, distribution, or sale of AI-generated content using my artwork, I reserve the right to permanently blacklist and block them.None of my artwork, including commissioned artwork, may be minted, tokenized, registered, or sold as an NFT under any circumstances.My artwork may not be incorporated into blockchain-based products, services, or projects without my explicit written permission.Clients involved in the unauthorized creation or sale of NFTs using my artwork will be permanently blacklisted and blocked including a DMCA takedown request.

Client Responsibilities

Respectful and appropriate communication is required throughout the commission process.Any abusive, harassing, threatening, aggressive, discriminatory, or intentionally disruptive behavior will result in the immediate cancellation of the commission without a refund.I reserve this right in order to maintain a respectful and safe working relationship.If I require information, clarification, approval, or feedback from a client and receive no response for an extended period of time, the commission may be placed on hold. Prolonged inactivity may result in cancellation without refund.The client is responsible for reviewing WIPs and providing feedback when sent.Approval of a sketch, design, or final product indicates that the client is satisfied with that stage of the commission.I am not responsible for changes requested after the client has approved a previous stage when those changes are not the result of an error on my part.Any mistakes made on my behalf (e.g. misread description, missed a detail, etc) will be corrected for free. On the other hand, if the mistake happened because of insufficient information or you forgot to mention something when ordering I will not make any changes unless paid to do so.Clients are responsible for providing accurate and complete information when ordering.
This includes providing:
・Correct references
・Accurate descriptions
・Important design details
・Required dimensions, specifications, or platform requirements
・Any information that may affect the final productIf you fail to provide important information before I begin working, changes resulting from the missing or incorrect information may require an additional fee.Clients are responsible for ensuring that they have the appropriate permission and rights to provide any references, artwork, logos, characters, or other materials submitted for their commission. Before a commission begins, clients must provide proof that they have permission to use or provide such materials, including confirmation from the original creator when applicable. I reserve the right to decline or pause a commission until sufficient permission or proof of authorization has been provided.

Usage Rights

Clients receive permission to use their completed commission for its intended purpose only.
See the specific ToS section for your type of commission for further information on what is defined as intended purpose.Commissions may not be:
・Resold
・Traded
・Licensed to another party
・Edited or changed without permission
・Used commercially
・Used on merchandise
・Used in products or services
・Used to generate revenueCommercial use, merchandising, use in products or services or being used to generate revenue must be discussed and approved before the commission is ordered and will require an additional fee.Purchasing a commission does not transfer copyright ownership.

Revisions & Changes

Minor revisions are included when they are reasonably within the scope of the original commission.Examples of artist errors include:
・Misreading the provided description
・Missing a clearly stated design detail
・Incorrect colors or markings that were specified in the orderMistakes made by me will be corrected free of charge.However, changes caused by the client providing insufficient information, changing their mind, or requesting details that were not included in the original order may require an additional fee.Major redesigns, significant alterations, or repeated revisions will require an additional fee or a new commission.

Refunds & Cancellations

Refunds will not be issued after I have started for any reason, except where I am unable to complete the commission due to circumstances on my end.If I cancel a commission due to circumstances on my end, I will determine an appropriate refund based on the amount of work that has already been completed.No refund will be issued when a commission is cancelled because of:
・Client misconduct
・Violation of these Terms
・Fraudulent activity
・A chargeback or payment dispute
・Undisclosed prohibited content
・Client-requested cancellation (unless in special cases)

Chargebacks & Payment Disputes

Fraudulent chargebacks, false payment claims, or disputes initiated after work has begun or been delivered may result in permanent blacklist and blocking.I will provide relevant commission records, messages, payment information, and completed work to the applicable payment processor or platform when responding to fraudulent disputes.

Roblox Clothing

I will upload the clothing through my own Roblox account(s).Clothing will be uploaded with my required watermark and template.You will not receive a copy of my clothing template.Purchasing the clothing does not transfer copyright ownership of the artwork or template to the client.I am not responsible for Roblox removing, moderating, or otherwise affecting the clothing after it has been uploaded. Such circumstances do not qualify for a refund or replacement. If I still have the file I will offer to reupload the clothing.

Personal Use Roblox Clothing

Personal clothing commissions will be uploaded to my Roblox group, [SYD] INC.The clothing will be sold to the client and then placed off-sale permanently.

Group Use Roblox Clothing

Spacer :)

Group use clothing commissions will be uploaded to the group you direct me to upload it to.This clothing is allowed to be put on sale automatically as it falls under the usage rights for this type.The client is required to maintain the following designated credit and description at all times in the items description:

Discord Assets

Will be given to you in their completed form as a PNG file.Removing my watermarks/signature will constitute a breach of these terms and will result in copyright enforcement including a DMCA takedown request.I understand that crediting assets can be difficult on Discord.At minimum, if someone asks who created the asset, you must provide my name and direct them to my website or social media.If possible, I strongly encourage clients to place a permanent link to my website alongside the asset I created in a specific credits channel.Usage rights include

Streaming Assets

Will be given to you in their completed form as a PNG file if static, if moving they will be sent as a MP4 unless otherwise requested.Removing my watermarks/signature will constitute a breach of these terms and will result in copyright enforcement including a DMCA takedown request.Usage rights include:
・Layouts may be used during Twitch streams, YouTube livestreams, Youtube videos/shorts, Twitch clips
・Intros/Outro may be used during Twitch streams, YouTube livestreams, Youtube videos/shorts, Twitch clips
・Twitch panels are to be used solely for your Twitch about section unless written approval is granted to use it in other places
・Being used in material posted to social media platforms, including but not limited to YouTube, TikTok, Instagram, Twitter/X, Discord, and other social media or content-sharing platforms.For assets used on Twitch, clients are required to create a credit area in their about section and link to my websiteFor Youtube and other social media I understand that crediting can be difficult. At minimum, if someone asks who created the asset, you must provide my name and direct them to my website or social media.If you are unsure whether your intended use falls within the permitted usage outlined above, please feel free to reach out and ask before ordering. Carrd Website

Either I will build the website on your account via being a collaborator or you can have me host it for a small fee as I am limited in the amount of sites I can host at a given time.If hosted on my account this will allow you the perks of the plan I have included in the hosting fee.On the footer wil be written "© LadyMysteries" if this is removed it constitutes a breach of these terms. If you'd like to you may also include a credit area that links to my wesbite or have the footer link to my website.
